Revising the UDDA: Why we tried, why we failed, where do we go from here?
DescriptionThe Uniform Determination of Death Act (UDDA) identifies two legal way to declare death: death by circulatory-respiratory criteria or brain death/death by neurologic criteria (BD/DNC). Due to concerns identified by multidisciplinary experts, a Drafting Committee to Revise the UDDA was empaneled in 2021. I served as an observer on the Committee and provided content expertise related to BD/DNC. In September 2023, the revision process was put on an indefinite pause. Members of the neurocritical care community should understand the shortcomings of the UDDA relative to BD/DNC determination. In this session, I will review why we tried to facilitate UDDA revision, why we failed and where we go from here.
